Industrial Relations

Middletons has a highly skilled Workplace Relations team that delivers specialist legal advice in a timely and commercial manner on industrial disputes. The team acts for employers, government bodies, small business and insurers on a wide range of industrial relations issues. We are acknowledged for our commercial approach and we are committed to helping our clients find practical solutions to legal issues, with full consideration of the business implications involved.

We are committed to building relationships with our clients. Our team aims to develop and implement strategies that allow our clients to improve operational management and stabilise and improve workplace relations.

Middletons has extensive experience in assisting employers to successfully negotiate workplace agreements and Australian workplace agreements with their employees and union representatives. We also have a detailed understanding of the impact of restructuring, outsourcing and privatisation on employer obligations and employee entitlements.

Our Workplace Relations team has broad experience providing proactive and strategic guidance in the management of workplace change and industrial disputation.

In dispute situations, we take the pragmatic view that winning a protracted industrial battle in the courts and tribunals is of little value if it cannot be sustained on the ground, and comes at the expense of operational effectiveness and/or relationships with employees in the long term.

Our Workplace Relations team has extensive experience in the provision of strategic and tactical advice in establishing workplace arrangements with employees and/or unions, by drafting and negotiating employment and enterprise agreements and by responding to legal action by the institution of proceedings in the Supreme Court, the Federal Court, the Australian Industrial Relations Commission and the NSW Industrial Relations Commission.
